DEFEATING THE PREJUDICE, EMBRACING EQUALITY

April 7, 2021 Accepting Yourself

September 06, 2018, an important day will be marked for the LGBT community in India. The Supreme Court of India abolished Section 377 of the Indian Penal Code (IPC). The law came into effect in 1982. It said that sexual intercourse against the law of nature and that of a man, a woman, or an animal was punishable by life imprisonment or at least ten years in prison, with no fine.

Today’s judgment marks the beginning of an impartial administration of LGBT society in our country. For too long the community has been plagued and harassed. They were treated like discarded classes, always. But the decision to repeal Section 377 is a big start for equality.

Chief Justice Dipak Misra and Judges DY Chandrachud, AM Khanwilkar, Indu Malhotra and Rohinton Fali Nariman have ruled that the LGBTQ community will now have the same sexual rights as everyone else.

Journey
In 2009, the Delhi Supreme Court ruled that any act of consensual homosexuality is illegal. However, Judge G S Singhvi later confirmed the decision and said that members of Parliament could make any decision on the matter.

However, in April 2014, the Supreme Court recommended that the government declare transgender people a third party and that they should be able to exercise all rights under the law and questioned the OBC community. The Naz Foundation in April 2016 filed and the Chief Justice, TS Thakur decided a similar review and a constitutional bench of five other members.

The decision
Finally, following a few steps over time, here is the decision, made for the welfare of the LGBTQ community. From the general public to the United Nations, everyone commends this decision. There is a lot of joy in the whole world.

Psychological Benefits of Judgment
This decision is an appropriate step in the direction of equality as there will be no harassment or labeling of any other sexual activity. This may not completely eradicate prejudice, but it will open the door to acceptance by people of the LGBT community. Homophobia and harassment will end, which has been one of the main reasons in the past for them to stay in the closet. Homosexuals who marry people of the opposite sex out of shame may now go out and end their unhappy marriages.

Accepting others for who they are is the greatest support one can give one another. Sex is not something you get, it is very natural.

All protests and protests eventually lead to a fruitful outcome. From here on, there will be hearts full of love and heads raised with pride.
